Commentary: GOP should drop 'racist' tactic regarding Sotomayor

In the interest of preserving a vital two-party system, two words of advice for the Republican radical right: Back off.

Back off calling Supreme Court nominee Sonia Sotomayor a racist.

In the first place, there is no evidence of that. And, second, spinning an incendiary diatribe out of her reasonable, if ill-chosen, words about the value of life experience to judicial wisdom, will ultimately be self-defeating. The Grand Old Party better act a little grander if it wants to get any older.

Issues don't get to the Supreme Court, or very far in our judicial system, unless there's a legitimate and probably subtle question about how to interpret the law.

That means judges, in addition to teasing out legal precedent must exercise judgment (that word!) on how to apply the law. (For the record, an analysis of Sotomayor's judicial opinions found that in the majority of discrimination cases she rejected claims by minorities.)
