RALEIGH — The man accused of killing UNC student body president Eve Carson was sent back to prison for at least 20 months on Thursday for violating the terms of his probation. A lawyer for Demario Atwater told the judge Atwater didn't know he was on probation because Wake County probation officers didn't contact him for more than a year.
Atwater, 21, pleaded guilty to violating his probation in two separate cases: a break-in for which he was convicted in 2005 in Wake County and a gun possession charge to which he pleaded guilty in 2007 in Granville County. Atwater was accused of failing to make payments and perform community service. Superior Court Judge Ripley Rand revoked Atwater's probation and activated what had been suspended sentences, meaning Atwater will serve 20 to 35 months in prison.
State probation officials have acknowledged that they neglected to supervise Atwater before Carson was killed March 5. He still faces charges in that case.
