A journalist who was kicked out of his embedded assignment in Afghanistan has now lost his lawsuit filed in response.
Wayne M. Anderson sued after being expelled from his slot with the Minnesota National Guard in 2010. The expulsion followed the events of July 20, 2010, when he filmed an ambulance offloading American personnel who had been attacked in a controversial shooting. On July 29, 2010, Anderson's story about the shooting and video of the ambulance offloading were published on The Washington Times website.
Military officials pulled Anderson's credentials, saying his video showed the identifiable faces of wounded soldiers, contrary to the media ground rules. Anderson sued.
In a 20-page decision Friday, U.S. District Judge John Bates dismissed the lawsuit, concluding that Anderson "had no viable constitutional claim."
"Anderson," Bates elaborated, "does not have a constitutionally protected right to be an embed journalist."
