Prosecutors in Sandusky case offer details of alleged sex abuse

BELLEFONTE — Six of Jerry Sandusky's 10 accusers alleged they were abused in the former defensive coordinator's College Township home.

And authorities said Sandusky abused eight of the 10 boys on Penn State's campus.

The places of the alleged abuse were among the details that prosecutors handed over Thursday to Sandusky’s attorney, Joe Amendola, in a bill of particulars.

Requesting a bill of particulars is common practice before trial, and the filing Thursday fulfilled Amendola’s request in January for the information.

The information disclosed was the age of the accusers at the time of the allegations, the location the allegations took place and a date or year range of the alleged abuse. Prosecutors didn’t disclose that information in their charging documents last year.

The exact dates of each allegation were not provided. Prosecutors wrote that all of the known accusers were children, one as young as 8 and one as old as 17, and don’t recall the dates.Sandusky has denied he abused the boys.

Amendola may ask for a “more specific response” from the prosecution, he said, but didn’t elaborate. None of the details in the bill of particulars will change how they’re preparing Sandusky’s defense, he said. A spokesman with the Attorney General’s Office declined to comment.

Prosecutors wrote they don’t know the identities of accusers No. 2 — the boy who former assistant coach Mike McQueary said he saw with Sandusky in an “extremely sexual” position in a shower in 2002 — and No. 8, a boy who a janitor saw with Sandusky in a shower in 2000.

The document shows that six of the accusers are alleging Sandusky abused them in his residence, 130 Grandview Road in College Township, between two periods: 1996 to 2002 and 2005 to 2009.Furthermore, none of the allegations in the bill of particulars appear to have happened before 1996. The grand jury’s presentment, released in November, charged that Sandusky abused boys as far back as 1994.

And none of the allegations appears to have happened in 2003 or 2004.Eight of the boys were allegedly abused on Penn State’s campus in the Lasch Building, the East Area Locker Room, an outdoor pool and on-campus dorms, both while Sandusky was on the football staff and after he retired in 1999.

The alleged abuse on campus occurred from 1996 through 2002, the latter being the year former Athletic Director Tim Curley and now-retired senior administrator Gary Schultz told Sandusky not to bring young boys on campus. They told a grand jury they met with Sandusky soon after McQueary’s report of the incident. Whether any allegations of abuse occurred on campus after that meeting is unknown.

Curley and Schultz face perjury charges that they lied to the grand jury about what they knew of the 2002 incident. They maintain their innocence, and are asking a judge to drop their cases.Other locations of alleged abuse include State College hotels, and in Tampa, Fla., and San Antonio during Penn State bowl game trips.

Last week, Penn State was served with a subpoena from federal authorities that’s indicative of a federal investigation, because the crimes are alleged to have occurred across state lines. Penn State has said it’s complying with the requests.

Sandusky remains on house arrest awaiting a May trial.

Senior Judge John Cleland has set a May 14 jury selection date. On Wednesday, he denied the defense’s request to delay the trial until the summer.

The judge previously ruled that a Centre County jury will hear the case. Jury summonses are expected to be mailed in mid-April.

The main courtroom in the courthouse has been reserved for the trial from May 14 through June 1.Here is a breakdown of the information in the bill of particulars as provided by prosecutor Jonelle Eshbach:

Victim 1: The boy, who was 11 to 15, was allegedly abused between 2005 and 2008 at Sandusky’s home, as well as an unspecified hotel near Sandusky’s home and the alleged victim’s school in Clinton County.

Victim 2: The date, as stated in the grand jury’s presentment, was March 1, 2002, at the Lasch Building. McQueary testified in December that he happened upon Sandusky and a young boy in a locker room shower on that date. McQueary testified he didn’t see intercourse but thought because of how close they were positioned that it was sexual in nature.

Victim 3: The abuse is alleged to have happened between the summer of 2000 and late 2002 in Sandusky’s home, the Lasch Building showers and on Penn State’s campus. The boy said he was 13 to 15.

Victim 4: The boy, who was 12 to 17 between 1996 and 2000, alleged the abuse happened in Sandusky’s home, in the showers at the East Area Locker Rooms, the Toftrees hotel, and at the Outback Bowl in Tampa in December 1998 and January 1999 and the Alamo Bowl in San Antonio in December 1999.

Victim 5: This accuser told prosecutors he was abused over more than five years, between the fall 1996 and 2002. He alleges he was abused in the East Area Locker Rooms when he was 8 to 12 years of age.

Victim 6: This allegation, which Sandusky addressed on national TV by saying he was just showering with a young boy, took place between 7 and 9 p.m. May 3, 1998, prosecutors wrote. The boy was 11.

Victim 7: The alleged offenses occurred between 1996 and 1999 in Sandusky’s home and the East Area Locker Rooms when the boy was as young as 11 and as old as 14.

Victim 8: This allegation stems from a janitor’s report that he saw Sandusky performing oral sex on a young boy in the Lasch Building. Prosecutors wrote it occurred on a Thursday or Friday evening in November 2000 in the assistant coach’s locker room. The boy is thought to have been between 11 and 13 years old, and his identity is unknown, according to prosecutors.

Victim 9: This accuser said he was abused between the summer of 2005 and 2009 at Sandusky’s residence and the pool and fitness center of the Hilton Garden Inn on East College Avenue, which is about a mile from Sandusky’s home. The boy says he was 13 to 15 or 16 when the abuse happened.

Victim 10: The alleged abuse occurred between the summer of 1997 and 1999 at Sandusky’s home, the outdoor pool on Penn State’s campus and in Sandusky’s car. The boy was 10 to 12 years old.
