A Harrisburg attorney said Tuesday he’s representing a man who’s alleging Jerry Sandusky sexually abused him in 2004 during a Second Mile program on Penn State’s campus.

Chuck Schmidt, of the firm Schmidt Kramer, said he plans to file a civil suit in a few weeks against Penn State, The Second Mile and Sandusky, likely in Dauphin County. Schmidt didn’t disclose say where his client lives today, to protect his identity.

The allegation is being investigated by the Attorney General’s Office and state police, Schmidt said.

Schmidt said his client, who’s 19, was 12 when the single instance of alleged abuse occurred. Schmidt classified it as involuntary deviate sexual intercourse. The firm is still investigating the case and he doesn’t have a specific figure as to what damages he will seek in the lawsuit.

Schmidt said he plans to file the suit before the man turns 20, when the statute of limitations expires.

Schmidt said his client has flashbacks of the alleged abuse.

“It has had a very negative effect on his life. He relives the incident,” he said.
