A 10-year-old boy who fought for life after suffering a beating, allegedly by his mother's boyfriend, has died, police in Fresno, Calif., said Tuesday.

Seth Ireland, a fifth-grader at Columbia Elementary School, had been in critical condition at Community Regional Medical Center in downtown Fresno.

Fresno police filed a warrant to search the home of his mother, Rena Ireland, 40, and her boyfriend, LeBaron Vaughn, 32, on South Thorne Avenue. Police found and seized bloody towels and clothing there plus Vaughn's size 13 shoes.

Officers said Seth's mother watched the attack and failed to interfere.

Two of Seth's brothers, 7 and 5, told police they heard him crying but didn't see him beaten.
