SACRAMENTO, Calif. -- Nancy Garrido's attorney has won a key step in his fight to remain on the high-profile kidnapping case, with a state appeals court issuing a stay in a lower court's order that he be ousted.

Defense attorney Gilbert Maines filed a request late Wednesday with the 3rd District Court of Appeal asking that Monday's scheduled hearing in El Dorado Superior Court be delayed. The appeals court responded with an order that temporarily halts his removal from the case.

The court offices were closed Friday, but Maines' law office posted a copy of the one-page order on its Web site, www.maineslaw.com, just after noon Friday.
